The Administrator makes every effort to protect the privacy of the users of its website (www.proballooning.com). The Administrator applies all necessary measures to protect the data against loss, destruction, disclosure, access by unauthorized persons or misuse. On this page you will find basic information about the data we use.

2. What data is processed?

The administrator processes the following personal data, the provision of which is
necessary to register on the website:

  • First and Last Name,
  • E-mail address

To make purchases through the website:

  • First and Last Name,
  • Gender
  • Delivery address
  • Phone number
  • E-mail address

Data provided by the User optionally:

  • Date of birth
  • PESEL number (if invoice is requested)
  • NIP number (in case of an invoice request for an entrepreneur)

In the case of withdrawal from the contract or acknowledgment of the complaint, when the reimbursement is made directly to the User’s bank account, we also process the information about the bank account number in order to make the reimbursement.

In addition, the administrator also processes the following data: place of residence, weight and age

3. For what purpose does the controller process data?

The Administrator processes the User’s personal data in order to properly perform the services provided and to properly perform the sales contract. This means that the data is needed in particular for:

  • Registering on the website;
  • Concluding a contract
  • Carry out settlements
  • Delivery of the goods ordered by the User or performance of the services
  • Your exercise of any consumer rights (e.g. withdrawal from the contract, warranty)
  • Sign up for a balloon flight

The User may also agree to receive information about news and promotions, which will result in the controller also processing personal data in order to send the User commercial information regarding, among others, new products or services, promotions or sales.

Personal data shall also be processed in the framework of fulfilling legal obligations incumbent on the controller and fulfilling tasks in the public interest, among others, to perform tasks related to security and defence or keeping tax records.

Personal data may also be processed for the purposes of direct marketing of products, securing and asserting claims or protecting against claims of the User or a third party, as well as marketing of services and products of third parties or own marketing, which is not a direct marketing

4. How do we obtain data?

All the data we have comes directly from you, i.e. you provide it by filling in the contact form.

5. Do i have to provide my information?

Providing your data is completely voluntary. Nevertheless, if you do not provide it, we will not be able to answer the question asked in the contact form.

6. How long do we process personal information?

In principle, personal data will only be stored for as long as necessary to fulfil the contractual or statutory obligations for which it was collected. The data will be deleted immediately when storage is no longer necessary, for evidential purposes, in accordance with civil law or in connection with a statutory retention obligation.

Information relating to the contract shall be stored for evidential purposes, for a period of three years, starting from the end of the year in which the business relationship with the User is terminated. The deletion of the data will take place after the expiry of the statutory limitation period for the assertion of contractual claims.

In addition, the Administrator may retain archival information on the concluded transactions, since their storage is related to the User’s claims, e.g. under warranty.

If no contract has been concluded between the User and the Owner, the User’s personal data are stored until the deletion of the User’s account on the website. The deletion of the account may occur as a result of the User’s request, withdrawal of consent for the processing of personal data, or objection to the processing of such data.

7. Legal basis for processing personal data

Personal data is processed in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation), OJ L 119, 4.5.2016, p. 1-88, hereinafter: “GDPR Regulation”.

The Administrator processes personal data only after obtaining the User’s consent, expressed at the time of registration on the website or upon confirmation of the transaction made on the website.

Expressing consent to the processing of personal data is completely voluntary, however, failure to grant it makes it impossible to register on the website and make purchases via the website.

8. Confirmation of data processing to other entities

The administrator may entrust the processing of personal data to entities cooperating with the administrator, to the extent necessary for the implementation of the transaction, e.g. to prepare the ordered goods and deliver shipments or provide commercial information from the administrator (the latter applies to Users who have consented to receive commercial information).

In addition to the purposes set out in this Privacy Policy, Users’ personal data will not be disclosed to third parties or transferred to other entities in any way for the purpose of sending marketing materials of these third parties.

Website Users’ personal data is not transferred outside the European Union.

This Privacy Policy complies with the provisions of Art. 13 sec. 1 and sec. 2 of the GDPR

9. What rights do I have in relation to data processing?

In addition to your right to object to processing, you also have the the right to:

  • access to your data,
  • rectify your data,
  • erasure of your data,
  • Limit the processing of your data,
  • transfer of your data.

Notwithstanding the above, you may file a complaint with the national supervisory authority (currently GIODO, and in the future the President of the Office for Personal Data Protection) if the Controller violates the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 26 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

10. Cookies
